Effective Date: June 5, 2026  |  Last Updated: June 5, 2026

1. Acceptance of Terms

Welcome to Pizza Luce. These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "Customer," "you," or "your") and Pizza Luce ("Company," "we," "us," or "our"), governing your access to and use of the website located at eat-lucepizza.click (the "Website") and all related services, features, content, and functionality offered through the Website (collectively, the "Services").

By accessing, browsing, registering on, or using the Website in any manner — including placing an order, submitting a form, or simply visiting — you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately discontinue your use of the Website and Services.

These Terms apply to all visitors, registered users, customers, and any other persons who access or use the Website. If you are using the Website on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and in that case, "you" and "your" will refer to that entity.

You must be at least 18 years of age (or the age of majority in your state of residence, whichever is higher) to use our Services. By using the Website, you represent and warrant that you meet this age requirement. If you are under the applicable age of majority, you may only use the Website under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

We do not guarantee that the Website will be available at all times. The Website may be temporarily unavailable due to scheduled maintenance, unscheduled downtime, or causes beyond our control.

3. User Accounts and Registration

Certain features of the Website may require you to register for an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information during the registration process
  • Maintain and promptly update your account information to keep it accurate, current, and complete
  • Maintain the security and confidentiality of your password and account credentials
  • Notify us immediately at [email protected] of any unauthorized use of your account or any other breach of security

We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms, provided false information, or engaged in conduct that is harmful to us, other users, or third parties. You may not create more than one account, share your account credentials with any third party, or use another user's account without permission.

4. User Obligations and Prohibited Activities

By using our Website and Services, you agree to use them only for lawful purposes and in a manner consistent with all applicable local, state, federal, and international laws and regulations. You agree that you will not:

  • Violate any applicable federal, state, local, or international law or regulation
  • Engage in any fraudulent, deceptive, or misleading conduct when placing orders or interacting with our Services
  • Attempt to gain unauthorized access to any portion of the Website, other accounts, computer systems, or networks connected to the Website

  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
  • Submit false, inaccurate, or misleading information in connection with orders or account registration
  • Use automated scripts, bots, or other tools to access or interact with the Website
  • Post, transmit, or distribute any content that is defamatory, obscene, threatening, harassing, offensive, or otherwise objectionable
  • Infringe upon or violate the intellectual property rights or other rights of Pizza Luce or any third party
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise tamper with any portion of the Website's software
  • Use the Website to send unsolicited commercial communications (spam) to other users or third parties

Violation of any of the above prohibitions may result in immediate termination of your access to the Website and Services, and may expose you to civil and/or criminal liability under applicable United States law, including but not limited to the Computer Fraud and Abuse Act (18 U.S.C. § 1030) and applicable state statutes.

5. Ordering, Payment, and Pricing

When you place an order through our Website, you are making an offer to purchase food items subject to availability and our acceptance. Pizza Luce reserves the right to refuse or cancel any order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, or errors in your order.

5.1 Pricing

All prices displayed on the Website are in United States Dollars (USD) and are subject to change without prior notice. Prices do not include applicable taxes unless otherwise stated. Sales tax will be calculated and added to your order total at checkout in accordance with applicable federal, state, and local tax laws.

5.2 Payment

We accept various forms of payment as displayed on the Website at the time of checkout. By submitting payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your payment method for the total amount of your order, including applicable taxes, fees, and delivery charges (if applicable).

All payment information is processed through secure, third-party payment processors. Pizza Luce does not store full payment card information on its servers. We are not responsible for any errors, losses, or issues arising from your payment processor or financial institution.

5.3 Refunds and Cancellations

Due to the perishable nature of food products, all sales are generally final once an order has been prepared. If you have a concern about an order — including incorrect items, quality issues, or missing items — please contact us immediately at [email protected]. We will review your concern and, at our sole discretion, offer a refund, replacement, or store credit as appropriate.

Orders may be cancelled only if cancellation is made before the order enters preparation. Once preparation has begun, cancellation and refund eligibility will be assessed on a case-by-case basis.

6. Delivery and Pickup

Pizza Luce offers delivery and/or pickup options as displayed on the Website. Delivery availability, estimated times, and any associated delivery fees are subject to change and will be presented to you during the checkout process. Estimated delivery times are approximations only and are not guaranteed.

You are responsible for providing accurate delivery address information. Pizza Luce is not liable for failed deliveries resulting from inaccurate or incomplete address information provided by you. Risk of loss and title for food items pass to you upon delivery or your pickup of the items, as applicable.

7. Intellectual Property Rights

The Website and all of its content, features, and functionality — including but not limited to text, graphics, logos, photographs, images, audio clips, video clips, data compilations, software, and the overall design and look-and-feel of the Website (collectively, "Content") — are owned by Pizza Luce or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Pizza Luce's name, logos, trademarks, service marks, trade names, and trade dress are the exclusive property of Pizza Luce. You may not use any of these marks without prior written consent from Pizza Luce. All other trademarks and service marks appearing on the Website are the property of their respective owners.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website solely for personal, non-commercial purposes in connection with ordering food and using our Services. This license does not include the right to:

  • Modify, adapt, or create derivative works based on the Website or its Content
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website or its Content for commercial purposes
  • Republish, upload, post, transmit, or distribute any Content without express prior written permission
  • Remove any copyright, trademark, or other proprietary notices from any Content

Any unauthorized use of the Content or Website terminates the limited license granted above and may constitute copyright infringement, trademark infringement, or other violations of applicable law, subjecting you to civil and/or criminal liability.

8. User-Generated Content

If you submit, post, or otherwise contribute any content to the Website, including reviews, feedback, comments, photographs, or suggestions ("User Content"), you hereby grant Pizza Luce a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media format and through any media channels.

You represent and warrant that: (a) you own or otherwise control all rights to the User Content; (b) the User Content is accurate and does not violate any applicable law; (c) the User Content does not infringe the intellectual property rights, privacy rights, or other rights of any third party. Pizza Luce reserves the right to remove any User Content at its sole discretion without notice.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information are governed by our Privacy Policy, available on the Website and incorporated into these Terms by reference. By using our Services, you consent to our collection and use of your personal information as described in the Privacy Policy.

To the extent you are a resident of California, your privacy rights are additionally protected under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). Please refer to our Privacy Policy for information on how to exercise your rights under these laws.

Our data practices are also subject to the Federal Trade Commission Act (FTC Act), which prohibits unfair or deceptive practices in commerce, including those related to privacy and data security.

10. Disclaimers and "As-Is" Basis

THE WEBSITE AND ALL SERVICES, CONTENT, MATERIALS, AND INFORMATION PROVIDED THROUGH THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
  • WARRANTIES THAT THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • WARRANTIES AS TO THE ACCURACY, RELIABILITY, COMPLETENESS, OR CURRENCY OF ANY CONTENT
  • WARRANTIES THAT DEFECTS WILL BE CORRECTED
  • WARRANTIES THAT THE WEBSITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

PIZZA LUCE MAKES NO WARRANTY OR REPRESENTATION THAT THE RESULTS OBTAINED FROM USE OF THE SERVICES WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

Nutritional information, ingredient lists, and allergen information provided on the Website are for general informational purposes only. While we make reasonable efforts to ensure the accuracy of such information, Pizza Luce makes no representation or warranty regarding the completeness or accuracy of nutritional or allergen data. 11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIZZA LUCE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, REVENUE, GOODWILL, OR ANTICIPATED SAVINGS
  • LOSS OF DATA OR INFORMATION
  • BUSINESS INTERRUPTION

  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN
  • ANY ERRORS, MISTAKES, OR INACCURACIES IN CONTENT
  • ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE TRANSMITTED THROUGH THE WEBSITE BY ANY THIRD PARTY

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF PIZZA LUCE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL PIZZA LUCE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIZZA LUCE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you in full. In such states, Pizza Luce's liability shall be limited to the greatest extent permitted by applicable law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Pizza Luce and its respective officers, directors, employees, agents, contractors, licensors, suppliers, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorneys' fees) arising out of or related to:

  • Your access to or use of the Website and Services
  • Your violation of any provision of these Terms
  • Your violation of any third-party right, including but not limited to any intellectual property right, privacy right, or proprietary right
  • Your violation of any applicable federal, state, or local law or regulation
  • Any User Content you submit, post, or transmit through the Website
  • Any fraudulent, negligent, or willful misconduct by you in connection with the Services

Pizza Luce reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate fully with Pizza Luce in asserting any available defenses.

13. Third-Party Links and Services

The Website may contain links to third-party websites, applications, or services that are not owned or controlled by Pizza Luce. We have no control over and assume no responsibility for the content, privacy policies, terms of service, or practices of any third-party websites or services. We do not endorse or assume any responsibility for any third-party sites, information, materials, products, or services.

If you access any third-party website or service from the Website, you do so at your own risk and you understand that these Terms and our Privacy Policy do not apply to your use of such third-party sites. We encourage you to review the terms and privacy policies of any third-party websites or services you visit.

14. Governing Law and Jurisdiction

These Terms of Service and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the United States of America and the laws of the applicable state in which Pizza Luce is incorporated and operates, without regard to its conflict of law provisions.

To the extent that any lawsuit or court proceeding is permitted under these Terms, you and Pizza Luce agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in the applicable state of Pizza Luce's principal place of business. You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

These Terms are subject to applicable federal consumer protection laws, including the Federal Trade Commission Act (15 U.S.C. § 45 et seq.). Nothing in these Terms shall be construed to limit any rights you may have under applicable consumer protection laws that cannot be waived by agreement.

15. Dispute Resolution and Arbitration

15.1 Informal Resolution

Before initiating any formal dispute resolution process, you agree to first attempt to resolve any dispute, controversy, or claim arising out of or relating to these Terms, the Website, or the Services ("Dispute") informally by contacting Pizza Luce at [email protected]. We will attempt to resolve the Dispute informally within thirty (30) days of receiving your notice. If the Dispute is not resolved within that period, either party may proceed to arbitration as described below.

15.2 Binding Arbitration

Except for Disputes that qualify for small claims court, you and Pizza Luce agree to resolve any Disputes through final and binding arbitration conducted by a recognized arbitration organization (such as the American Arbitration Association ("AAA")) in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in the applicable state where Pizza Luce maintains its principal place of business, unless otherwise agreed by the parties. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

15.3 Class Action Waiver

YOU AND PIZZA LUCE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

15.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or other proprietary rights.

16. Term and Termination

These Terms of Service shall remain in full force and effect for as long as you use the Website or maintain an account with Pizza Luce. We reserve the right, in our sole discretion, to:

  • Terminate or suspend your access to the Website and Services at any time, with or without cause or notice
  • Delete your account and all associated data in accordance with our Privacy Policy
  • Discontinue or modify any aspect of the Services without notice

You may terminate your account at any time by contacting us at [email protected] and requesting account deletion. Termination of your account does not relieve you of any obligations you incurred prior to termination, including payment for any orders placed.

Upon termination for any reason, all provisions of these Terms that by their nature should survive termination shall survive, including without limitation: ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.

17. Changes to Terms of Service

Pizza Luce reserves the right to revise and update these Terms of Service at any time and at our sole discretion. All changes are effective immediately upon posting to the Website, and the "Last Updated" date at the top of these Terms will be revised accordingly.

We will make reasonable efforts to notify you of material changes to these Terms, which may include posting a notice on the Website's homepage, sending an email to the address associated with your account, or displaying a prominent notification on the Website. However, it is your responsibility to review these Terms regularly to stay informed of any changes.

Your continued use of the Website or Services following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Website and Services immediately and, if applicable, delete your account.

18. Force Majeure

Pizza Luce shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, governmental actions, civil unrest, labor disputes, power outages, internet service disruptions, cyberattacks, or any other circumstances outside of our reasonable control.

19. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices or policies published on the Website, constitute the entire agreement between you and Pizza Luce with respect to the subject matter hereof, and supersede all prior and contemporaneous agreements, understandings, representations, and warranties, both written and oral, with respect to the Website and Services.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law by a court of competent jurisdiction or arbitrator, that provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if such modification is not possible, it shall be severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect.

The invalidity or unenforceability of any provision of these Terms in any jurisdiction shall not affect the validity or enforceability of that provision in any other jurisdiction, or any other provision of these Terms in any jurisdiction.

21. Waiver

No waiver by Pizza Luce of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of Pizza Luce to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

No waiver shall be effective unless it is in writing and signed by an authorized representative of Pizza Luce.

22. Assignment

You may not assign or transfer your rights or obligations under these Terms, whether by operation of law or otherwise, without the prior written consent of Pizza Luce. Any attempted assignment in violation of this section shall be null and void.

Pizza Luce may freely assign or transfer these Terms or its rights and obligations hereunder without restriction and without notice to you. These Terms shall be binding upon and inure to the benefit of the parties and their respective permitted successors and assigns.

23. Electronic Communications

By using our Website and Services, you consent to receive electronic communications from Pizza Luce, including but not limited to order confirmations, account notifications, promotional offers (if you have opted in), and notices regarding updates to these Terms or our policies. You agree that any such electronic communications satisfy any legal requirement that such communications be in writing.

You may opt out of promotional communications at any time by following the unsubscribe instructions included in such communications or by contacting us at [email protected].
